These Terms of Use constitute a legally binding agreement between you and Camasmie Gillet Inc. (“Koda,” “we,” or “us”). They govern your use of the Koda platform, including our website, mobile applications, and all related services (collectively, the “Service”). Our Service is built on a zero-knowledge architecture, which means we have no access to the content you store with us. All encryption and decryption of your documents happen on your device, ensuring only you can view your data. By using our Service, you agree to these Terms and our Privacy Policy, which details our commitment to this security model.

To use our Service, you must be at least 18 years old and have the legal capacity to enter into a binding contract. By creating an account, you represent and warrant that you meet these requirements. If you are using Koda on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. You are responsible for ensuring that your use of the Service complies with all laws, rules, and regulations applicable to you. The Service is not available to any users previously removed from the Service by Koda.

You are solely responsible for all activities that occur under your account. Because of our zero-knowledge architecture, your password is your master key. You are the only one who can access your account. If you lose your password, we cannot recover it for you, and you will lose access to your data permanently. This is a necessary consequence of our commitment to your privacy and security. You agree to keep your password confidential and to not share it with any third party. You must notify us immediately of any unauthorized use of your account.

Koda grants you a limited, non-exclusive, non-transferable, and revocable license to use our Service for your personal or internal business purposes, subject to these Terms. You own your content. We do not claim any ownership of the documents or other content you store in Koda. Our Service’s AI features operate on your encrypted data without ever decrypting it on our servers, ensuring your content remains private. You are responsible for the legality, reliability, and appropriateness of all content you store on Koda.

You agree not to misuse the Koda Service or help anyone else to do so. This includes refraining from uploading or sharing any content that is illegal, harmful, or violates the rights of others. You must not attempt to circumvent any security features of the Service, nor access, tamper with, or use non-public areas of the Service. Furthermore, you agree not to interfere with or disrupt any user, host, or network, or use the Service for any purpose other than its intended use.
Because we cannot see your content, we rely on you to use our service responsibly. We reserve the right to investigate and take appropriate action, including account suspension or termination, in response to reports of abuse or illegal activity.

All rights, title, and interest in and to the Koda Service (excluding user content) are and will remain the exclusive property of Koda and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Nothing in these Terms gives you a right to use the Koda name or any of the Koda trademarks, logos, domain names, and other distinctive brand features. We welcome your feedback, but please note that we may use your feedback without any obligation to you.

You are free to stop using our Service at any time. We also reserve the right to suspend or terminate your access to the Service with notice to you if you are in breach of these Terms, or if your use of the Service would cause a real risk of harm or loss to us or other users. Upon termination, your right to use the Service will immediately cease. When your account is terminated, your encrypted data will be permanently deleted from our servers. Because of our zero-knowledge architecture, this data is not recoverable by us or anyone else once deleted.
